Kali's Kardhouse – Terms of Service

These Terms of Service (“Terms”) are a binding legal agreement between you (“you,” “your,” or “Customer”) and Kali's Kardhouse (“we,” “us,” or “our”) governing your access to and use of our website, Kaliskardhouse.com (the “Site”), and the purchase of products or services from us (collectively, the “Service”).

By accessing the Site, creating an account, or making a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Return Policy, Privacy Policy, and any other policies referenced herein. If you do not agree, you must not use our Site or Services.

1. Eligibility

1.1 You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Site or make purchases. If you are between the ages of 13 and 18, you must have parental or legal guardian consent.

1.2 By using our Site, you represent and warrant that you have the legal capacity to enter into a binding agreement and that all information you provide to us is accurate and complete.

2. Prohibited Uses

You may not use the Site or Services for:

  • Any unlawful or fraudulent purpose

  • Violating any applicable law or regulation

  • Infringing intellectual property rights

  • Using bots, scrapers, or automated purchasing software

  • Transmitting malicious code or engaging in activity that could damage our systems

Violation of this section may result in immediate termination of your account, order cancellation, IP bans, and legal action.

3. Restricted Access & Denial of Service

Kali's Kardhouse reserves the right, at its sole discretion, to restrict, suspend, or permanently block any customer account from accessing our website or making purchases. Reasons for such action may include, but are not limited to:

  • Abusive, fraudulent, or suspicious activity

  • Chargebacks or disputes inconsistent with our policies

  • Attempts to circumvent purchase limits or restrictions

 

  • Behavior deemed harmful to our business, staff, or community

Any orders placed by a restricted account, or attempts to circumvent restrictions through the creation of new accounts, false information, or use of third-party identities, will be cancelled without notice. Kali's Kardhouse further reserves the right to pursue additional remedies, including but not limited to reporting fraudulent activity to payment processors, law enforcement, and pursuing civil claims where applicable.

4. Orders & Payment

4.1 We reserve the right to refuse, cancel, or limit any order at our sole discretion, including suspected fraudulent or unauthorized transactions.

4.2 Orders must be paid in full at the time of purchase. Payment processing is handled by secure third-party providers; we do not store full payment details.

4.3 Orders that are canceled at the customer’s request are subject to our Return Policy and any applicable fees.

4.4 Orders cannot be combined or merged once they have been placed.

5. Pricing & Availability

5.1 Prices are subject to change without notice.
5.2 Product availability is not guaranteed and may be subject to distributor allocation. If a product is unavailable, we may cancel your order and issue a refund.

6. Pre-Order Policy

Pre-orders are governed by the following terms:

  • Payment is collected at the time of order.

  • We cannot ship items before the official release date.

  • All pre-orders are non-refundable. Exception requests are subject to a 15% cancellation fee and may result in account restrictions.

  • If you order both pre-order and in-stock items, your order will ship when all items are available.

  • Release dates may change due to manufacturer or distributor delays.

Accounts may be suspended from placing future pre-orders for violations of these terms.

7. Promotions & Coupons

7.1 Promotional codes, discounts, and special offers are subject to change or termination at any time without notice.
7.2 Discounts cannot be applied retroactively to completed purchases.

8. Product Condition & Packaging

8.1 We sell manufacturer-sealed products. We are not responsible for:

  • Minor cosmetic imperfections to packaging (e.g., scuffs, dents, corner wear)

  • Printing inconsistencies or minor defects in factory-sealed items

  • Issues that do not affect the integrity of the contents

8.2 Packaging is designed to protect the product inside. We will not replace packaging for wear and tear sustained during shipping.

Returns & Cancellations

Our Return Policy governs all returns, cancellations, and refunds. By purchasing from us, you agree to those terms.

10. Intellectual Property

All content on the Site — including images, product descriptions, and trademarks — is owned by Kali's Kardhouse or its licensors and may not be copied, reproduced, or used without prior written consent.

11. Disclaimers & Limitation of Liability

11.1 Products are sold “AS IS” and “AS AVAILABLE” without warranties, except where required by law.
11.2 To the fullest extent permitted by law, Kali's Kardhouse shall not be liable for any indirect, incidental, or consequential damages arising from use of the Site or purchase of products.
11.3 In no event shall our liability exceed the amount paid for the order giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Kali's Kardhouse, its affiliates, and employees from any claims, damages, or expenses arising from your breach of these Terms or violation of applicable law.

13. Dispute Resolution & Governing Law

13.1 These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

13.2 Any disputes shall be resolved exclusively in the state or federal courts located in Macomb County, Michigan, unless subject to binding arbitration as outlined below.

13.3 For disputes arising out of purchases, both parties agree to resolve claims through binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA). Class actions and class arbitrations are prohibited.

14. Changes to Terms

We may update these Terms from time to time. The “Effective Date” at the top of this page indicates the last revision date. Continued use of our Site constitutes acceptance of the updated Terms.
